HikerFeed Terms of Use

Effective Date: April 1, 2026

These Terms of Use ("Terms") govern your access to and use of HikerFeed, including our website, mobile applications, and related services (collectively, the "Service"). HikerFeed is operated by Drew Bartlett ("HikerFeed," "we," "us," or "our"). By using the Service, you agree to these Terms.

If you do not agree to these Terms, do not use the Service.

1. Eligibility

You must be at least 13 years old to use HikerFeed. By using the Service, you represent that you meet this requirement and that you are legally able to enter into these Terms.

2. The Service

HikerFeed is a hiking-focused app and web platform where users can document hikes, share photos, post in forums and threads, follow other users, place pins on maps, track hiking-related information, and participate in community features.

We may modify, suspend, or discontinue any part of the Service at any time.

3. Accounts

You may need to create an account to use some features. For now, accounts are created using email and password.

You agree to:

  • provide accurate information;
  • keep your login credentials confidential;
  • promptly update your account information if it changes; and
  • accept responsibility for activity that occurs under your account.

You may delete your account through the Service where that functionality is available.

4. User Content

You may be able to submit, upload, create, or share content through HikerFeed, including posts, comments, photos, map pins, forum content, thread content, profile information, and hiking, distance, or fitness-related information (collectively, "User Content").

You keep ownership of your User Content.

However, by posting or submitting User Content to the Service, you grant HikerFeed a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, process, adapt, modify for technical purposes, display, perform, distribute, and otherwise use your User Content as needed to operate, improve, promote, and provide the Service.

If you choose to make User Content public, you also grant HikerFeed permission to use, reproduce, display, distribute, and feature that public User Content for marketing, promotional, and editorial purposes related to HikerFeed.

This license is limited to the purposes of running and promoting HikerFeed and ends within a commercially reasonable time after your content is deleted from the live Service, except to the extent content has been shared with others, retained in backups, or kept for legal, security, or operational reasons.

You represent that:

  • you own your User Content or have all rights needed to post it;
  • your User Content does not violate any law or any third party's rights;
  • your User Content does not infringe intellectual property rights, privacy rights, publicity rights, or contract rights; and
  • your User Content is not misleading, fraudulent, or harmful.

5. Content Visibility and Privacy Choices

HikerFeed allows users to choose whether certain content is public or private. You are responsible for using the privacy settings provided and for understanding the visibility of the content you post.

If you choose to make content public, that content may be visible to other users and may be copied, shared, or discussed by others.

6. Acceptable Use

You agree not to:

  • post unlawful, abusive, harassing, threatening, defamatory, or hateful content;
  • post nudity or sexually explicit content;
  • impersonate another person or misrepresent your affiliation;
  • spam, scam, or manipulate engagement;
  • post content that infringes another person's intellectual property or other rights;
  • interfere with or disrupt the Service;
  • attempt to gain unauthorized access to accounts, systems, or data;
  • scrape, reverse engineer, or exploit the Service except as allowed by law; or
  • use the Service in a way that could harm HikerFeed or its users.

7. Moderation and Enforcement

We may review, remove, restrict, or refuse User Content, and we may suspend or terminate accounts, if we believe content or conduct violates these Terms, creates risk for HikerFeed or others, or is otherwise inappropriate for the Service.

We are not obligated to monitor all content, but we may do so.

8. Health, Fitness, and Outdoor Activity Disclaimer

HikerFeed may allow users to record or share hiking-related, map-related, pin-related, distance-related, or fitness-related information. This information may be incomplete, inaccurate, outdated, user-generated, or misleading.

HikerFeed is not a medical service, safety service, emergency service, rescue service, or navigation tool. The Service does not replace your own judgment, official trail information, weather information, land management guidance, emergency preparation, or appropriate hiking safety practices.

Outdoor activities involve risk, including injury, illness, getting lost, dangerous terrain, wildlife encounters, weather exposure, and death. You use the Service and participate in outdoor activities entirely at your own risk.

9. Third-Party Services

The Service may rely on or integrate with third-party services, including map providers, analytics providers, and other vendors. HikerFeed is not responsible for third-party services or their content, policies, or availability.

10. Intellectual Property

The Service, excluding User Content, is owned by HikerFeed or its licensors and is protected by applicable intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial use.

You may not copy, modify, distribute, sell, or lease any part of the Service except as allowed by law or with our written permission.

11. Termination

You may stop using the Service at any time.

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you violated these Terms or if it is necessary to protect the Service, users, or third parties.

Sections that by their nature should survive termination will survive, including sections on User Content licenses, disclaimers, limitation of liability, indemnity, and dispute-related terms.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, HIKERFEED DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not guarantee that the Service will be secure, uninterrupted, error-free, accurate, or available at any particular time.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HIKERFEED AND ITS OWNER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF HIKERFEED FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

14. Indemnification

You agree to defend, indemnify, and hold harmless HikerFeed and its owner from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your User Content, your use of the Service, or your violation of these Terms.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms and update the Effective Date above. Your continued use of the Service after the updated Terms take effect means you accept the revised Terms.

16. Governing Law

These Terms are governed by the laws of the State of Vermont, without regard to conflict of law principles.
